Trilogy Product Tester Terms & Conditions

TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your participation in the Trilogy Beta One Product Tester Application (the “Program”). By submitting an application, you acknowledge that you have read, understand, and agree to be legally bound by these Terms.

1. Eligibility

To apply or participate, you must:

  • Be a legal resident of the United States;
  • Be at least 18 years of age; and
  • Submit truthful and accurate information in the application.

2. Application and Selection

Submitting an application does not guarantee selection as a product tester. Trilogy will select participants at its sole discretion. Trilogy may revoke participation at any time for any reason.

Trilogy may contact applicants to notify them of selection status and to coordinate next steps related solely to this Program.

3. Tester Obligations

If selected as a product tester, you agree to:

  • Install and use the Beta One prototype putter grip;
  • Complete a follow-up survey as requested;
  • Participate in an optional video call of up to 30 minutes, if requested; and
  • Provide all requested feedback within 90 days of receiving the product.

There are no additional usage requirements beyond normal play. You agree not to misuse, alter, or intentionally damage the prototype.

4. Ownership of Prototype

Selected testers will receive the Beta One prototype putter grip free of charge and may keep it permanently. No product return is required.

5. Public Posting and Sharing

The Program is public. Testers may share photos, videos, or commentary about the prototype on social media or other public channels. Trilogy does not require confidentiality or restrict content sharing.

6. Feedback Ownership and Usage Rights

By submitting feedback, ideas, suggestions, reviews, survey responses, comments, images, data, or other information (“Feedback”), you agree that:

  • All Feedback becomes the exclusive property of Trilogy, without compensation.
  • Trilogy may use, reproduce, publish, adapt, or display Feedback for marketing, research, and product development purposes.
  • Trilogy may use Feedback with general, non-identifying descriptors (e.g., “10-handicap tester,” “a golfer in Arizona”) but will not use your full name or other personally identifying information without your express consent.
  • You irrevocably assign and waive any rights or claims related to the Feedback, including rights to ideas, improvements, or inventions you may suggest.

7. No Compensation

Participation in the Program is voluntary. Aside from receiving the prototype grip at no charge, no financial or other compensation will be provided.

8. Program Changes and Termination

Trilogy may modify, suspend, or terminate the Program, or any participant’s involvement, at any time and without notice.

9. Assumption of Risk & Release of Liability

By participating, you acknowledge and agree that:

  • Golf and product installation carry inherent risks.
  • You assume all risk associated with the installation and use of the prototype product.
  • Trilogy is not liable for any injuries, damages, losses, installation issues, equipment failure, or consequential damages arising from participation or use of the prototype.

To the fullest extent permitted by law, you release Trilogy, its officers, employees, contractors, and affiliates from all claims arising out of or related to your participation.

10. Contact and Communications

By applying, you consent to receive communications from Trilogy solely related to the Program, including:

  • Application status updates;
  • Selection or non-selection notices;
  • Shipping and logistics information;
  • Surveys, follow-up requests, and reminders (up to two additional follow-ups); and
  • Optional scheduling of video calls.

You will not be added to general marketing lists or receive unrelated promotional communications.

11. Privacy

Application information will be used exclusively for administering the Program and evaluating eligibility. Trilogy will not sell, share, or use application data for unrelated marketing.

12. Governing Law & Arbitration

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any disputes arising out of or related to these Terms or the Program shall be resolved exclusively through binding arbitration administered by a recognized arbitration provider in North Carolina.

Participants waive the right to bring claims in court or to participate in class actions.

13. Acknowledgment of Beta Status, Disclaimer of Warranties & Release

  • The Product is a pre-release, beta-stage product and may contain defects or performance variations.
  • Participation in the Program is entirely voluntary and does not guarantee selection. Trilogy makes no guarantee of selection, performance, safety, or suitability of the Product, and no particular outcome or benefit is promised or implied.
  • The Product is provided “AS IS” without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • By applying to or participating in the Program, each Tester acknowledges and voluntarily assumes all risks arising from use of the Product and participation in the Program.
  • To the fullest extent permitted by law, each Tester releases, discharges, and agrees to hold harmless Trilogy Sports LLC, its affiliates, officers, employees, and agents from any and all claims, liabilities, losses, or damages of any kind arising out of or relating to the Product or the Program.

14. Entire Agreement

These Terms constitute the full agreement regarding the Program and supersede any prior understandings. If any provision is deemed unenforceable, the remaining provisions will remain in full force.
